Justice Ofili-Ajumogobia to face trial as court dismisses application challenging jurisdiction by : 12:19 pm On June 29, 2019

Justice Rilwan Aikawa of the Federal High Court in Lagos on Friday dismissed the preliminary objection filed by Justice Rita Ofili-Ajumogobia challenging the jurisdiction of the court to hear her trial.

 

Justice Ofili-Ajumogobia through her counsel, Chief Robert Clarke, had challenged the jurisdiction of the court to hear her trial on the grounds that she is still a judge of the Federal High Court and as such could not be tried in line with the precedent set in the case of Justice Hyeladzira Nganjiwa.

 

At Friday proceedings, Justice Aikawa ruled that justice Ajumogobia was no longer a judicial officer because she had been dismissed by the President on the recommendation of the NJC, therefore she can be tried for any criminal offence accused of.

 

The judge held that in the letter presented by the EFCC, the President had already dismissed Justice Ofili-Ajumogobia on November 6, 2018, and therefore she was no longer a judicial officer. Justice Aikawa subsequently adjourned till October 24, 25 for trial.

 

The EFCC had re-arraigned Justice Ofili-Ajumogobia and a Senior Advocate of Nigeria, Godwin Obla on 18 counts, to which they pleaded not guilty before Justice Aikawa.
